Terms & Conditions
These Terms & Conditions (“Terms”) govern your access to and use of the Geoki360 POS application and related services (the “System”) provided by Geoki360 / Geoki E-Market (“Company”, “we”, “us”, or “our”). By accessing or using the System, you agree to be bound by these Terms. If you do not agree, do not use the System.
1. Acceptance of Terms
By creating an account, downloading, installing, or using Geoki360 POS, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy.
2. Use of the System
- The System is provided for facilitating point-of-sale, inventory, invoicing, and related business operations.
- You must be at least 18 years old, or the legal age of majority in your jurisdiction, to use the System.
- You are responsible for ensuring your use complies with all applicable laws and regulations in Kenya and any other jurisdiction where you operate.
- You may not reverse engineer, misuse, disrupt, or attempt unauthorized access to the System or other users’ data.
3. Account registration
- You agree to provide accurate, current, and complete information during registration and to keep it updated.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
- You must promptly notify us of any unauthorized use of your account.
- Business owners are responsible for the actions of staff or sub-users they invite into their workspace.
4. Business data and content
- You retain ownership of the business data you enter into the System (products, sales, customers, etc.).
- You grant us a limited license to host, process, and display that data solely to operate the System for you.
- You are responsible for the accuracy of invoices, taxes, stock, and financial records generated through the App.
5. Subscriptions, payments, and renewals
- Some features may require a paid plan, subscription, or in-app purchase.
- Fees, billing cycles, and renewal terms will be shown at the time of purchase.
- Unless stated otherwise, paid fees are non-refundable except where required by law.
- We may suspend or limit access if payment fails or an account is in arrears.
6. Third-party services
The System may integrate with third-party services such as payment processors, messaging apps, cloud hosting, analytics, and printers. Your use of those services may be subject to their own terms. We are not responsible for third-party outages, fees, or policies.
7. Availability and updates
- We aim to keep the System available but do not guarantee uninterrupted or error-free operation.
- We may update, modify, or discontinue features with or without notice.
- You are responsible for installing recommended app updates for security and compatibility.
8. Intellectual property
The Geoki360 POS software, branding, logos, and related materials are owned by the Company or its licensors. These Terms do not transfer any ownership rights to you other than a limited, non-exclusive license to use the System as permitted.
9. Disclaimer of warranties
The System is provided “as is” and “as available” to the fullest extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement, except where such disclaimers are not allowed.
10. Limitation of liability
To the maximum extent permitted by law, the Company is not liable for indirect, incidental, special, consequential, or lost-profit damages, or for loss of data arising from your use of the System. Our total liability for any claim relating to the System is limited to the fees you paid us for the System in the three (3) months before the claim, or KES 0 if you use a free plan.
11. Termination
You may stop using the System at any time. We may suspend or terminate access if you breach these Terms, misuse the System, or fail to pay applicable fees. Provisions that by nature should survive termination (including ownership, liability limits, and indemnities) will survive.
12. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted at this URL with a revised effective date. Continued use after changes means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of Kenya. Courts in Kenya shall have jurisdiction, without prejudice to any mandatory consumer protections that may apply.
